Please read these Terms of Service ("Terms") carefully before using the Prompty macOS application ("the Service") operated by Prompty ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

1. Licensing Model

Prompty is sold under a lifetime license model. Your purchase grants you a non-exclusive, non-transferable right to use Prompty subject to the following conditions:

• 1 Mac Limit: A standard lifetime license is valid for use on exactly one (1) Mac device at a time.
• No Family Sharing: Our licenses are for individual use and do not support Apple's Family Sharing or similar multi-user distribution mechanisms.
• No Subscriptions: The purchase is a one-time payment. There are no recurring monthly fees for the software itself.
• Updates: Your license includes free updates for all minor releases within the major version you purchased (e.g., all 1.x updates). We reserve the right to charge an upgrade fee for future major versions (e.g., 2.0).

Prompty offers a 15-day free trial. Upon expiration of the trial, you must purchase a license to continue using the software.

2. "Bring Your Own Key" (BYOK) & AI Usage

Prompty integrates with third-party Artificial Intelligence APIs (e.g., OpenAI, Anthropic, Google). Prompty does not provide AI generation credits or tokens.

• You are solely responsible for obtaining, managing, and securing your own API keys.
• You are solely responsible for all costs, fees, and overages incurred with your third-party API providers resulting from your use of Prompty.
• You agree to comply with the Terms of Service and Acceptable Use Policies of the respective AI providers whose APIs you use within Prompty. We reserve the right to revoke your license without refund if you use Prompty to orchestrate abuse of third-party APIs.

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Prompty and its licensors. The Service is protected by copyright, trademark, and other laws.

You may not reverse engineer, decompile, or disassemble the application, except and only to the extent that such activity is expressly permitted by applicable law.

4. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

We do not warrant that the application will be uninterrupted, error-free, or fully compatible with future macOS updates or third-party API changes.

5. Limitation of Liability

In no event shall Prompty, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any errors or disruptions in third-party APIs; or (iv) unauthorized access, use or alteration of your transmissions or content.

6. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
